Privacy Policy

How MercResolution collects, uses, and protects your personal and business information.

1. Introduction

MercResolution ("we," "our," or "us") is committed to protecting your privacy. This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you visit our website, use our commercial debt optimization and debt resolution services, interact with our AI chat assistant, or otherwise communicate with us. MercResolution provides services exclusively to businesses and business owners regarding commercial (business) debt; we do not offer services for consumer or personal debts.

Please read this Privacy Policy carefully. If you do not agree with the terms of this Privacy Policy, please do not access the site or use our services. This Policy is provided in English, and the English version is legally binding; any translation is provided for convenience only.

2. Information We Collect

2.1 Information You Provide to Us

We may collect personally identifiable information that you voluntarily provide to us when you:

  • Contact us through our website, by phone, by text message, or by email
  • Request our debt optimization or debt resolution services
  • Complete applications, intake questionnaires, or onboarding documents
  • Subscribe to our newsletter or communications
  • Fill out forms on our website

This information may include: name, business name, job title or role, email address, phone number, mailing address, financial information related to your debt situation, and any other information you choose to provide.

2.2 Sensitive Financial Information

To evaluate your business's debt situation and provide our services, you may provide — or authorize us to review — sensitive business and financial records, such as bank statements, revenue and receivables information, financing agreements, merchant cash advance contracts, creditor statements, and schedules of debt obligations. We use this information solely to evaluate and service your matter, restrict access to it to personnel and providers who need it for that purpose, and handle it as described in this Policy. Please provide sensitive records only through the secure channels we designate, and not through the AI chat or other unsecured channels.

2.3 AI Chat Assistant Conversations

If you interact with our automated AI chat assistant ("Stephanie"), we collect and retain the contents of those conversations. We use chat transcripts to respond to you, to route and follow up on inquiries, to train and improve the assistant and our services, and for quality, security, and compliance purposes. Chat transcripts may be reviewed by our team. Please do not submit highly sensitive information — such as bank account numbers, Social Security numbers, or passwords — through the chat.

2.4 Information From Third-Party Sources

We may receive information about businesses and business owners from third-party sources, such as lead generation and referral partners, commercial business-data providers, and publicly available business records. We may combine this information with information you provide. We use it to respond to referrals, to evaluate whether our services may be relevant to your business, and to communicate with you as described in this Policy. If you received a communication from us based on information from a third-party source and you prefer not to hear from us, you may opt out at any time using the methods described in Section 5.

2.5 Automatically Collected Information

When you visit our website, we may automatically collect certain information about your device and your visit, including your web browser type, IP address, time zone, pages viewed, links clicked, access times, and referring URLs, as well as information about the cookies installed on your device. We collect this information through the cookies and similar technologies described in Section 3.

3. Cookies and Tracking Technologies

Our website uses cookies and similar tracking technologies. The categories we use are:

  • Essential cookies: Required for the website to function and remain secure — for example, to load pages, process forms, and maintain security. These cannot be switched off.
  • Preference cookies: Remember choices you make, such as your language selection (English or Spanish) and your cookie-consent preferences.
  • Analytics cookies: Help us understand how visitors use the website so we can improve it. Where required by law, analytics cookies are set only with your consent.

When you first visit the website, a cookie-consent banner allows you to accept or manage non-essential cookies. You may change your preferences at any time through the consent tool where available, and you can control or delete cookies through your browser settings. If you block essential cookies, parts of the website may not function properly.

Do Not Track: Some browsers transmit "Do Not Track" signals. Because there is no uniform industry standard for responding to these signals, our website does not currently respond to Do Not Track browser settings.

4. How We Use Your Information

We use the information we collect or receive:

  • To provide, operate, and maintain our debt resolution services
  • To evaluate your business's debt situation and develop optimization and resolution strategies
  • To communicate with you about your account or services
  • To process your transactions and manage your requests
  • To send you marketing and promotional communications (with your consent, where required)
  • To operate, maintain, and improve the AI chat assistant
  • To respond to your inquiries and provide customer support
  • To analyze and improve our website and services
  • To comply with legal obligations and protect our legal rights
  • To prevent fraud and enhance security

5. Phone, Email, and SMS Communications

If you provide your telephone number or email address, we may contact you about your inquiry, your account, and our services, as described in our Terms and Conditions. Where required by law, we send marketing communications only with your consent.

You may opt out of these communications at any time: reply STOP to any text message to end text messages (reply HELP for help); use the unsubscribe link in any marketing email; or contact us directly using the information in Section 16. Message frequency varies; message and data rates may apply. Opting out of marketing will not affect transactional or service-related communications about an active engagement.

We do not sell or share your mobile phone number or text-messaging opt-in data and consent with third parties or affiliates for their own marketing or promotional purposes.

6. Disclosure of Your Information

We may share your information in the following situations:

  • With Your Consent: We may disclose your information for any purpose with your consent
  • Service Providers: We may share your information with third-party service providers who perform services on our behalf, such as payment processing, data analysis, email delivery, and legal services, and who are contractually limited to using it to provide those services
  • Business Transfers: We may share or transfer your information in connection with a merger, sale, or acquisition of all or a portion of our business
  • Legal Requirements: We may disclose your information if required to do so by law or in response to valid requests by public authorities
  • Creditors: In the course of providing debt optimization and resolution services, we may share relevant information with creditors on behalf of our clients as necessary to facilitate debt resolution and negotiate improved terms
  • Legal Counsel: We may share your information with commercial litigation attorneys when necessary to protect your interests or enforce debt agreements

We do not sell your personal information, and we do not share it for cross-context behavioral advertising. Because we do not sell or share personal information in these ways, there is no sale or sharing for you to opt out of. If our practices change, we will update this Privacy Policy and provide any opt-out mechanism required by law before the change takes effect.

7. Data Security

We implement appropriate technical and organizational security measures designed to protect your personal information, including access controls and the use of secure channels for sensitive financial records. However, no electronic transmission over the Internet or information storage technology can be guaranteed to be 100% secure. While we strive to protect your personal information, we cannot guarantee its absolute security.

8. Data Retention

We will retain your personal information only for as long as necessary to fulfill the purposes outlined in this Privacy Policy, unless a longer retention period is required or permitted by law. In determining retention periods, we consider the nature of the information, the purposes for which it was collected, our ongoing relationship with you, and our legal, accounting, and dispute-resolution obligations. We will retain and use your information to comply with our legal obligations, resolve disputes, and enforce our agreements.

9. Data Breach Notification

We maintain incident-response procedures designed to identify, contain, and remediate security incidents. If a breach of your personal information occurs that triggers a notification obligation under applicable law, we will notify affected individuals and regulators as and when required by that law.

10. Your Privacy Rights

Depending on your location, you may have certain rights regarding your personal information:

  • The right to access and receive a copy of your personal information
  • The right to correct inaccurate or incomplete personal information
  • The right to request deletion of your personal information
  • The right to restrict or object to our processing of your personal information
  • The right to data portability
  • The right to opt out of the sale of personal information, targeted advertising, or certain profiling (noting that we do not sell personal information)
  • The right to withdraw consent at any time

To exercise any of these rights, please contact us using the information provided in Section 16. We may need to verify your identity — and, for requests submitted on behalf of a business, your authority — before acting on your request. Where permitted by law, you may use an authorized agent to submit a request, subject to verification of the agent's authority. If we deny your request, you may appeal by replying to our response with "Privacy Appeal" in the subject line; if your appeal is denied, you may have the right to contact your state attorney general.

11. State Privacy Rights

11.1 California Residents (CCPA/CPRA)

If you are a California resident, you have specific rights under the California Consumer Privacy Act, as amended by the California Privacy Rights Act (CCPA/CPRA), including: the right to know the categories and specific pieces of personal information we have collected about you; the right to request deletion and correction of your personal information; the right to opt out of the sale or sharing of personal information (we do not sell or share personal information); the right to limit the use and disclosure of sensitive personal information (we use such information only as necessary to provide our services); and the right not to be discriminated against for exercising any of these rights. You may exercise these rights yourself or through an authorized agent by contacting us as described in Section 16.

11.2 Texas and Other States

Residents of states with comprehensive privacy laws — including Texas under the Texas Data Privacy and Security Act (TDPSA) — may have rights similar to those described above, such as the rights to access, correct, delete, and obtain a portable copy of personal data, and to opt out of targeted advertising, the sale of personal data, or certain profiling. Please note that some of these laws, including the TDPSA, protect individuals acting in a personal or household context and do not cover individuals acting in a commercial or employment context; because our services are business-to-business, some of these laws may not apply to information you provide in your capacity as a business representative. Where a law applies to your information, we honor the rights it provides. To exercise any right, or to appeal a decision on a request, contact us as described in Section 16.

12. Third-Party Websites

Our website may contain links to third-party websites. We are not responsible for the privacy practices or content of these third-party sites. We encourage you to review the privacy policies of any third-party sites you visit.

13. Children's Privacy

Our services are not directed to individuals under the age of 18. We do not knowingly collect personal information from children under 18. If you become aware that a child has provided us with personal information, please contact us immediately.

14. International Users

Our website and services are intended for users located in the United States, and our services are offered only to U.S. businesses. If you access the website from outside the United States, you understand that your information will be transferred to, stored, and processed in the United States, where privacy laws may differ from those of your jurisdiction.

15. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. We will notify you of any changes by posting the new Privacy Policy on this page and updating the "Last Updated" date. You are advised to review this Privacy Policy periodically for any changes. Changes to this Privacy Policy are effective when they are posted on this page.
